“How is support calculated when my income is always changing?”
How California Courts View Income for Support
In California, courts use a guideline formula for child support and a needs-based analysis for spousal support. The starting point is figuring out your “gross monthly income.” This includes base pay (if any), overtime, shift differentials, holiday pay, bonuses, and sometimes workers’ comp.
Why You Don’t Want the Court Using Just One Pay Stub
If your spouse’s lawyer brings in a recent high-earning pay stub, the court might assume you make that amount all the time. That could result in inflated support orders. Instead, present a realistic, well-documented average over time.
What to Submit Instead: Income Averaging
The best method is to average your income over the past 12 months or more. Gather 12 months of pay stubs or dispatch summaries, your W-2s, tax returns, documentation of union dues and retirement contributions, and any workers’ comp or disability pay.
How Support Is Adjusted Over Time
Support orders can be modified. If your hours drop or you’re injured, file a request for modification with proof. Courts recognize the ILWU’s structure—but you must explain it clearly.
What About Spousal Support?
Spousal support is more flexible than child support. Judges look at lifestyle, marriage length, your ability to pay, and your spouse’s need. Your lawyer must show that your high-income weeks aren’t your norm.

Track your work type, number of shifts, gross earnings, and notes on slowdowns or injuries. Use a Google Sheet or notebook to keep your records ready for court.
