Artificial intelligence has quickly become part of everyday life. People use ChatGPT to draft emails, organize finances, prepare for meetings, and even think through personal problems. As a result, I’m starting to hear a new question from clients: “Can my ChatGPT conversations be used in my divorce?”

The honest answer is that there isn’t a simple yes-or-no rule. Whether AI conversations become relevant depends on the issues in the case, how the information was created, whether it is sought in discovery, and whether it is admissible under the applicable rules of evidence.

Using AI Doesn’t Make Information Private

Many people mistakenly assume that because they’re talking to an AI tool, the conversation can never become an issue in litigation. That’s a dangerous assumption. If you copy information from AI into emails, text messages, financial documents, parenting plans, or other evidence, those materials may become relevant depending on the facts of your case.

AI Is Not a Substitute for Legal Advice

One concern I have is seeing people rely on AI instead of getting advice tailored to California law. AI can help organize thoughts or explain general concepts, but it cannot evaluate the unique facts of your case or replace advice from an experienced family law attorney.

Think Before You Upload Information

Before uploading bank statements, medical records, children’s information, or confidential business documents into any AI platform, stop and consider whether you should be sharing that information. Understand the platform you’re using and think carefully about privacy and confidentiality before uploading sensitive material.

My No-BS Advice

AI is an incredible tool when used wisely, but it isn’t a strategy for winning your divorce. Use it to become more informed—not to replace your attorney, hide information, or make important legal decisions on your own. The smartest clients use technology as a resource while still getting experienced legal guidance.
