Artificial intelligence has become part of everyday life. People use it to draft emails, summarize documents, create budgets, and answer questions in seconds. It’s no surprise that many people are now asking whether AI can help them prepare for a divorce.
My answer is yes—with an important limitation. AI can be an excellent organizational tool, but it should not replace legal advice from an attorney who understands your specific facts.
Where AI Can Be Helpful
I’ve found that AI can help people prepare for their first consultation by creating timelines, organizing financial information, generating lists of questions, and helping them gather documents. Clients who come in organized often make much better use of their consultation because we can spend less time sorting papers and more time discussing strategy.
Where AI Falls Short
AI doesn’t know what information your spouse has omitted, how a particular judge may approach an issue, or what strategic decisions make sense in your case. It cannot cross-examine a witness, negotiate a settlement, or recognize subtle facts that may completely change the legal analysis.
Most importantly, AI doesn’t represent you. Your lawyer does.
Please Don’t Bring Me AI’s Legal Strategy
One trend I’m seeing more often is prospective clients arriving with pages of AI-generated legal analysis, arguments, or litigation strategies and expecting me to follow them.
Here’s my no-BS response: that’s usually not helpful.
AI has no access to all of the facts, it doesn’t know what evidence exists, it isn’t familiar with every procedural issue in your case, and it isn’t making strategic decisions based on years of California family law experience. Every minute spent trying to explain why an AI-generated strategy doesn’t fit your case is time we could have spent developing a strategy that actually does.
Instead of asking AI to tell you how to win your divorce, use it to help you organize your documents, prepare your questions, and understand basic legal terminology. Then let your attorney develop the legal strategy.
My No-BS Advice
Use AI to become a better-informed and better-organized client—not to become your own lawyer. Bring your financial documents, your questions, and your goals to your consultation. Leave the AI-generated litigation strategy at home. Your attorney’s job is to evaluate the facts, identify the legal issues, and build a strategy tailored to your case.
Frequently Asked Questions
Can AI write a parenting plan?
It can help create a draft, but it cannot determine whether the plan is realistic or appropriate for your family.
Can AI estimate support?
It may provide general information, but it cannot replace individualized legal advice.
Should I tell my attorney I’ve been using AI?
Absolutely. It helps your attorney understand what you’ve already reviewed and correct any misunderstandings.
